Haryana RERA orders Sarv Realtors to refund buyer's money for delayed flat
GURUGRAM: Eleven years after a couple booked a 3BHK unit for Rs 1.32 crore, Haryana Real Estate Regulatory Authority (HRera) directed a realtor to refund s 41.6 lakh — around 37% of the total cost taken as initial payment — along with 11.1% annual interest to them for failing to deliver possession of the in Supertech Hues, Sector 68.

had filed the complaint with the realty authority in Oct 2020 — the possession
was delayed by at least seven years, according to the agreement.
The order highlighted "substantial delays" in the project and dismissed the delays" in the project and dismissed the developer's reliance on demonetisation, construction bans and the Covid-19 pandemic as grounds for non-delivery. HRera observed that such claims "cannot justify keeping buyers waiting indefinitely." The dispute began in June 2014, when the Gowalkars booked the unit (1,765 sqft)
under a possession-linked plan. As per the agreement, possession was due by Dec 2017, with a grace period till June 2018.
Despite repeated reminders, the project remained incomplete. In 2017, the flat was shifted from Tower P to Tower O, but construction progress stayed stalled. By Jan 2020, Supertech transferred the project to Sarv Realtors without seeking buyer consent, further compounding uncertainties.
